The first one is for the prosecutor to show that the defendant’s blood alcohol content level was within the legal limit or more at the time he or she was driving. It can easily be proven by a breath test or a blood test. The second one is to prove that while driving, the defendant was under the influence of alcohol or drugs. In order to claim his attempt to prove the defendant is guilty, he will have to present the results of chemical tests and his or her driving behavior.
