My girlfriend got a DUI and she wants to get her license. She was told she needs to get an SR22 to get her license back. She doesn’t have a car right now so how does she get insurance for a car she does not have?

Your girlfriend will need a non-owners SR-22 if she does not own a car nor has a car in his household in which to place an car insurance policy upon.

If the state of VA requires an SR-22, certificate of financial responsibility, as part of the terms of reinstatement for your girlfriend’s driver’s license then she will need to acquire and maintain one even if she does not own a car. If you own a vehicle, normally you get the mandated liability coverages and SR22 filing on the car(s) you own. If you do not own a vehicle then you get a non-owners policy which is still the mandated coverages plus the get the SR-22 filed in Virginia as required there is just no vehicle to list on the policy.

Generally, a non-owners SR-22 permits the named insure to operate any car that they are given permission to drive by the vehicle owner, unless the car is owned by a household member.

I never had a driver’s license before, why am I being required to carry an SR22 in Virginia Beach, Virginia?

This will depend upon state laws and the reason behind why you are required to carry an SR-22. An individual can be mandated to carry this even without a driver’s license. According to the VA Department of Motor Vehicles , Financial Responsibility certifications (SR-22 or SR-26) are required in Virginia for unsatisfied judgments, driver license suspension as a result of a major conviction and uninsured motor vehicle suspension.

If you get caught doing any of these violations then even though you dont have a license yet, you could be required to get an SR-22.

Just because an individual does not have a driver’s license does not necessarily mean that the state has not began a driving record for the individual. If you get caught driving without a license and are also cited for a moving violation, these can be put in record under a driver’s record even if you have not acquired a license.
